Additional Service Agreement for Locker Rentals*

This rider to the membership agreement between Fitness Formula clubs (FFC), Sandburg Village Condominium Homeowners’ Association (“HOA”) and member listed above, is for additional, optional services requested by the member. It is hereby understood that the member has requested a rental locker and will be billed in full for the current pool season. No refunds will be honored if locker is not used for the full season.

Locker is required to be empty and cleaned out by the last day the pool is open for the current pool season.

Member is required to use an FFC Issued lock on rental lockers. All Non-FFC locks will be cut without notice. If your lock is lost, a new lock will need to be purchased.

Neither FFC, nor HOA shall not be liable for any loss of or theft or damage to, the personal property of members and guests, including items left in rental lockers. Rented lockers are for personal effects only. The Renter must not store in the Locker: (a) Any combustible, inflammable or hazardous materials or substances; (b) Any food or any other items that may have an objectionable odor or that may decay; (c) Any item that would result in a violation of any law or regulation; or (d) any objects of exceptional value.

All items should be removed from the locker no later than the last day of the current pool season.

There have been no verbal agreements or other agreements made to alter the terms of the Membership Agreement.

Member on their behalf, as well as anyone claiming through their membership, here by releases, waives, indemnifies and shall defend and hold harmless Fitness Formula clubs, Sandburg Village Condominium Homeowners’ Association, its Board of Directors, managing agent, and their respective trainers, employees, agents, administrators, owners, officers, directors, board members, managing agent, affiliates, representatives and others acting on their behalf (hereinafter “Released Parties”) from any and all claims, demands, losses, liabilities or damages to my person and/or property that I might sustain while participating in, arising out of, or on account of my use of facilities, equipment or machinery at the Club or its affiliated Fitness Formula clubs, INCLUDING BUT NOT LIMITED TO DEATH, DISABILITY, INFECTION OR DAMAGE TO PERSON OR PROPERTY, CAUSED OR ALLEGED TO HAVE BEEN CAUSED IN WHOLE OR IN PART, BY THE NEGLIGENT ACT OR OMISSION OF THE RELEASED PARTIES OR OTHERS ACTING ON THEIR BEHALF.

LIMITATION ON LIABILITY: TO THE EXTENT THERE ISANY LIABILITY TO MEMBER OR ANYONE CLAIMING THROUGH MEMBER, BY FFC OR HOA UNDER THIS AGREEMENT, SAID LIABILITY SHALL BE LIMITED TO NO MORE THAN THE AMOUNT PAID BY MEMBER UNDER THIS AGREEMENT.
